Patanjali Ayurved and its founders were facing contempt proceedings by the Supreme Court for breaking an agreement not to advertise “cures” in breach of the Drugs and Magic Remedies (Objectionable Advertisements) Act of 1954. The deceptive marketing campaigns of Patanjali, which included promises to treat COVID-19, obesity, diabetes, and liver problems, were perceived as willful breaking of the law.
The Uttarakhand government’s medicine licensing authority was condemned by Justices Hima Kohli and Ahsanuddin Amanullah for their inaction in response to the company’s deceptive advertisements. The court ordered the authorities to provide justification for their inaction against the company.
Reaction to Patanjali’s Apologies
Citing delays in the submission of documents to the court, the judge questioned the sincerity of the apologies made by Patanjali’s founders. The Ayurvedic Company’s senior advocate Mukul Rohatgi came under fire for the calibre of the affidavits that were turned in.
The court ordered the Uttarakhand government to terminate three officers for carelessness and made licensing agencies provide thorough justifications. The court rejected the company’s apologies and promises, finding them insufficient and casting doubt on their sincerity.
Future Steps
The court set a date for additional proceedings on April 23 and ordered government representatives to provide thorough affidavits explaining why they did not take action against the ayurvedic company.
