Shamima Begum, a British woman who joined ISIL (ISIS) in Syria while she was a schoolgirl, has lost her most recent attempt to get her citizenship back after the UK revoked it. On Friday, the Court of Appeal decided that it was acceptable to deny her British citizenship.
Shamima’s Citizenship Stripped in 2019
Soon after she was discovered at a camp for Syrian refugees in 2019, authorities revoked Begum’s British citizenship, and she has stayed there ever since. Her appeal to the Special Immigration Appeals Commission last year against the ruling was not successful
Unforgiving Choice or Personal Misfortune?
Though Begum may be viewed as “the author of her own misfortune,” the Court of Appeal agreed that the verdict may be viewed as “harsh.” The justices made it clear that their only responsibility was to determine whether or not the decision to revoke her citizenship was illegal.
Ineffective Debate
Begum’s attorneys claimed that the ruling was illegal, in part because British authorities were purportedly negligent in determining whether or not Begum was a victim of human trafficking. But in February 2023, a lower court dismissed this argument.
Final Appeal Rejected
Begum’s case was dismissed by all three judges of the Court of Appeal, notwithstanding a further attempt to reverse the ruling. According to Chief Justice Sue Carr, the court’s objective was to evaluate the decision’s legality rather than its severity.
