Dani Alves, one of the most accomplished soccer players of his time and a previous right-back for Barcelona and Brazil, has been found guilty of sexually assaulting a woman. A three-judge bench at the Barcelona Provincial Court rendered the decision on Thursday, sending the defendant to four years and six months in prison.
Conviction for Sexual Assault Under New Law
Alves was found guilty in accordance with Spain’s recently passed sexual liberty statute, which heavily emphasizes the victim’s lack of agreement as a determining factor in sex offenses. The incident in question happened on December 31, 2022, in a nightclub in Barcelona. As a result, the 40-year-old football legend was found guilty.
Varying Narratives and Absence of Consent
The victim’s lack of consent for the sexual encounter was deemed substantiated by the court. Throughout the trial, Alves—who has been detained on remand for more than a year—changed his account several times. The victim’s evidence, the injuries to her knee from Alves pushing her to the ground, and the actions of both parties afterward were all considered by the judges.
Dani Alves’s Sentencing and Compensation
In addition to Danis’ prison sentence, the court mandated that he compensate the victim with 150,000 euros ($163,000). The 40-year-old football player will serve five years of probation after his prison sentence ends.
Alves might ask to be released from the prison outside of Barcelona for brief periods of time after serving out a fourth of his sentence and fulfilling other prerequisites. In addition to the victim’s testimony, the court used the victim’s physical injuries, Dani’s actions, and the aftermath of the horrific occurrence to support its ruling.
